Puppies are sold as pets and companion animals unless otherwise contracted in writing. This agreement is a legal document between the buyer and seller. The buyer agrees that he/she has read and understands this agreement and no other guarantees or warranties have been made either expressed or implied by the Breeder/Seller. There are no binding amendments unless in writing.
Terms of Payment
Reserved Puppy - A puppy under 5 weeks is reserved with $500. A puppy over 5 weeks old is reserved with a deposit of 50% of total cost. Payment is due in full when a puppy is 10 weeks.Deposits and payments are not refundable if Buyer backs out of purchase of a reserved puppy. If the balance on a puppy is not received by 11 weeks of age seller has the right to sell the puppy to another party.
If the puppy not picked up within one week of the agreed upon date and time,unless other arrangements have been made and mutually agreed upon, seller has the right to sell the puppy to another party and buyer forfeits all right to the puppy and payments placed on the puppy.Deposits and payments are not refundable if Buyer backs out of purchase of a reserved puppy.
If by rare chance a reserved puppy our care becomes unsalable due to illness or death then buyer agrees to transfer deposits and payments over to another puppy of similar quality.No refunds Seller is not obligated to refund, no exceptions. Seller offers replacement puppies only,never refunds
48 hour Vet Examination- Buyer agrees to have a Veterinarian examine purchased puppy within 48 hours of adoption, including stool testing for parasites, coccidia and giardia. Once exam is complete and results are available, purchaser agrees to contact us by email and provide verification of results of all testing. Failure to provide tests results will nullify any agreed upon health warranty.
If upon first examination purchaser’s Veterinarian finds puppy to be genetically defective, the following steps must be taken:
Buyer must notify breeder within 2 days of findings and return puppy within 5 days of findings to Seller to be cured, or replaced at Sellers discretion.
Buyer agrees to be responsible for all transportation expenses incurred regarding return of original puppy to breeder and subsequent replacement puppy.
Any and all original copy breed registration paperwork must be returned to buyer. If said documents are not returned, buyer reserves the right to withhold subsequent registration until documents are returned.
14 day Parvo Warranty- We use Neopar vaccine for protection against CPV known as Parvo so it would be rare for a puppy from us to ever develope Parvo.If a purchased puppy exhibits signs associated with canine Parvovirus, mimicking illnesses MUST be ruled out immediately because infectious bacteria can cause signs similar to Parvo yet are easy to treat and resolve within 24 hours with the correct antibitotics and fluids. Antibiotics used for Parvo will not kill infectious bacteria so a puppy can die being treated for Parvo when in fact the puppy does not have Parvo. Since there are no fully reliable tests to diagnos Parvo, we contract with Buyers for a fecal glass slide test sent to a lab that can rule out mimicking illnesses if a puppy becomes weak with vomiiting or diarrhea or other signs assciated with a CPV .
A fecal slide test must be sent to a diagnostic lab by your Veterinarian within the first few hours of sickness. The diagnostic lab must rule out the clinical presence of the following conditions: Escherichia coli infection, Salmonella , Campylobacter and Giardia.
Fecal Parvo tests, both blood and office fecal types can be result in false positives due to prior immunization with Parvovirus vaccine.
The IV antibiotics to treat Parvo will not cure intestinal bacteria which must be treated with oral antibiotics so that the medication goes into the intestinal tract. Assuming a puppy has Canine Parvo virus can be fatal if the puppy has an intestinal bacteria instead. We will only offer a replacement puppy if the fecal glass slide test is sent to a lab with your Vet requesting the lab look for Escherichia coli infection, Salmonella , Campylobacter and Giardia.
3 day Parasite Discovery- We will reimburse at reasonable rates or at our county’s (San Joaquin County, California) cost for medication directly used to treat and cure parasites found at the required 48 hour Vet exam. If a puppy sold by us dies due to parasite overgrowth found at the 48 hour Vet exam, we will furnish buyer with a replacement puppy as long as:
A fecal test was done within 48 hours of buyer's receipt of the puppy.
Treatment commenced upon discovery and proper medication was promptly prescribed and administered to treat and eliminate the parasite.
A second diagnostic fecal test is sent to a lab by your Vet due to continuing loose stool, within 7 days of receipt of the puppy
An autopsy shows a parasite infestation is the main cause of death.
Genetic Health Warranty - Seller guarantees puppy until one year of age against life threatening congenital defects, (heart, kidney, lungs, brain). If within that time period a proven life threatening congenital defect is found the buyer must notify breeder within 5 days of findings if a claim is to be made. As long as breeder is notified of the findings within 5 days of diagnosis and given medical records and documentation of proof, then breeder will:
1.Allow Buyer to keep a genetically fatally ill puppy and receive a replacement puppy of equal quality, only once the Buyer has spent up to 100% or above the cost of the puppy in medical care for non elective medical treatments. Medical bills and proof of fatal genetic defect required.
OR
2.Replace puppy/dog with another of the same breed, quality, sex once original puppy is returned. The replacement will be subject to availability. Seller only agrees to replace a puppy to the owner on a one time basis only. Seller will not be responsible for illness or health problems that are diagnosed after the original claim is made.
If puppy is diagnosed as having a disabling, crippling, or deadly genetic defect, resulting in death or euthanasia, and buyer wants to apply to seller for replacement, puppy must have a post-mortem necropsy done (autopsy). Purchaser agrees to furnish seller with copies of all associated medical reports and medical records must be submitted to seller for review with seller's veterinarian. ______Initials
In the unlikely event of a puppy’s death in the first 12 months of life, due to a congenital defect, a necropsy (autopsy) from a state veterinary lab confirming such an event and cause is required before the Seller will take any action. Necropsy will be performed at buyer’s expense.
In addition, a photo of the deceased puppy must be sent with the necropsy report for I.D. verification.
Under no circumstances is purchased puppy to be euthanized without Sellers knowledge and consent.
De-worming- We de-worm our puppies a few times with NEMEX before they leave us. We also de-worm with 3 days of Panacur.
Vaccines- Vaccines that are needed: Distemper-Parvo-Parainfluenza- Adeno-2-Hepatitis
Since vaccines schedules may vary according to the growth, development and health of every individual puppy, a schedule will be provided to the purchaser in writing stating the immunizations given to date and next date immunizations are due.
Most breeders refuse to warranty the health of a puppy once the puppy is given certain recommended non-core vaccines. We are no exception.
Additionally, seller will not warranty puppy’s health if any of the red highlighted vaccines listed below are given during warranty period.
Restrictions on the other two vaccines( Bordetella and Rabies) must be adhered to in order to keep warranty.
Most breeders refuse to warranty the health of a puppy once the puppy is given certain non core vaccines. We are no exception.
Seller will not warranty puppies health if any of the three vaccines listed below is given during warranty period
Bordetella- Pets receiving the nasal drop form of Bordetella vaccination may experience a upper respiratory reaction. Chihuahuas are more likely to become sick from the nasal Bordetella than the injectable. Chihuahuas puppies given the nasal vaccines often come down with some degree of Kennel Cough which will require medications and treatment. Injectable Bordetella seems to have less side effects but can also make a puppy ill. Boarding facilities insist you give this vaccine.We advise to have a relative babysit and hold off the Bordetella until the puppy is and adult with full immune function. Chihuahua puppies can get very sick very fast from the nasal Bordetella.
If you have a Bordetella outbreak in your area then you need to weight the risks involved when deciding to use this vaccine.
Lepto- This vaccine is short lasting and has higher side effects with injury or death. We ask that your Vet does not give this vaccine until the puppy is 1 year old .There are more then one type of lepto disease servo types and the vaccine may not cover the disease in your area so you may end up exposing your puppy to a vaccine that does not protect against the servo types of Lepto in your area.
Corona is another vaccine with higher incident of side effects with injury or death. Research shows that Corona is a disease of younger puppies under 10 weeks of age.We do no release our puppies until minimum age 11 weeks so Corona should not be a concern.
Rabies
Rabies immunization given no sooner than 8 months of age in puppies who weigh less then 2 lbs at 4 months old and given no sooner then 6 months of age in puppies who weigh over 2 bs when 4 months old. Rabies vaccine must be given alone, never in combination with any other vaccines.Reasonably prudent veterinarians will hold off immunization until 6 to 8 months or older in tiny fragile small breed puppies.
If puppy is given rabies along with other vaccines at the same time, and/or before 20 weeks of age Seller will void health warranty.
Giardia vaccine is too new on the market to be administered to fragile small Chihuahua puppies.
There is not enough known regarding this vaccine and the potential side effects or long lasting health effects. Seller will void health warranty for puppies who receive this vaccine.
Heartworm medications often consist of a low dose ivermectin and some sensitive puppies and dogs can develop seizures or liver problems after months of use. Seller will not provide warranty of brain or liver if heartworm medication is given in the frist 12 months of the dogs life
Health Insurance- Seller encourages Buyer to purchase Puppy Health Insurance for non foreseeable accidents or illnesses that can be a financial hardship without health insurance.
Expenses - Purchaser agrees not to hold the Breeder responsible for veterinarian fees or medical expenses beyond any exclusively described and outlined within the confines of this sales agreement. Buyer understands and takes responsibility for puppy’s health, and medical care, actions, safety, and protection from the moment puppy leaves the Sellers hands. Buyer is responsible for all medical bills he incurs for the puppy and agrees to not hold the seller of said puppy responsible for any such incurred expenses. Seller does not pay any medical bills. ____________initials.
Health Insurance- Seller encourages Buyer to purchase Puppy Health Insurance for non foreseeable accidents or illnesses that can result in financial hardship without health insurance coverage.
Quality Guarantee: Seller does not pay any future vet bills for any reason. If a buyer is unhappy with the final outcome of size or quality of their dog at the age of 12 months, Seller is willing to accept the dog back with a 50% credit of money paid, excluding shipping and/or taxes, to apply toward purchase of a new puppy. Shipping is always the responsibility of buyer. This exchange policy is a one time offer per family. We do not warranty bites, ear shape or size, color of coat, or quality of coat, non genetic or non fatal conditions such as uncomplicated hernias, cosmetic defects, fertility of male or female including male’s testes. We also do not warranty against moleras of any type or size (open crease lines of skull called open fontanels, open creases of the skull usually close by 9 to 15 months of age), luxating patellas or conditions common to the breed that are neither fatal nor proven to be fully genetic in nature.
This warranty of obligation from breeder toward buyer is only active while breeder is alive and breeding dogs. Upon death of breeder or incapacitating illness which causes breeder to be unable to keep and breed dogs, this obligation will cease and no obligation will exist to the buyer from seller’s relatives or heirs.
Registration: Breeding rights must be approved by breeder before sale of the puppy, never after sale. Breeders are not responsible for actions of dog registries. Puppies sold with CKC or AKC registration. Papers will be completed and ready for you when your puppy is picked up at time of shipment, but once in a rare while it may take 30 to 60 days to mail the registration to you once puppy is in your custody. If you require a certain type of registration, Buyer must confirm with Seller that such registration is available before purchasing puppy, otherwise Breeder reserves the right to choose registry type and no changes nor refunds will be given if you change your mind later on.
Disclosure: California law allows contracts between buyer and seller as long as reasonable options of resolution exist, should a health issue arise. Our options for resolution are contained within this contract. You must decide if our terms are reasonable to you. If you do not find our options for resolutions fair and do not agree to our terms then you must not send a deposit or payment to purchase a puppy from us. We refuse to sell to anyone who does not agree to abide by the terms, policies and conditions described in their entirety herein.
Diet- Seller cannot warranty the bones, organs and brain on a puppy raised on a cheap store brand food. Please retain receipts for a quality puppy food food to show adherence to this guarantee.For puppies under 6 months we approve only Royal Canine Puppy, BIll Jack Puppy,Iams Puppy. Other quality foods such as Blue and Trilogy are also approved once puppy reached 6 months of age. Please inquire for approval of a dry puppy food you consider to be high quality.
Nuvet Supplement is required for contract to remain valid. This dietary supplement is needed for bone, cartilage and muscle development as well as eyes, brain and organs. Proper nutrition is the key to optimal health. To order please find the link on my home page. PRECAUTIONS UNTIL PUPPY is 7-8 MONTHS OLD: No greenies, rawhides,dried organ meats. Small breed puppies have weak immune systems made even weaker for a short period of time by monthly vaccinations. Small breed puppies can become ill in a matter of hours, from bacterial overgrowth of NORMAL dog bacterial or protozoa flora, or normal environmental bacteria and viruses. Chihuahuas can catch human strep throat, mycoplasma bronchitis, campylobactor, giardia, coccedia, salmonella, and many other germs and parasites from the cleanest appearing environment. These are not the illnesses that any Breeder has immune protection vaccines to prevent, but germs that are on the buyer's skin, floor, shoes, or environment, or on other persons, or pets, or around a vet's office or the airlines. Pups can get sick when they move to new homes, just like human children get sick when they go to school. Immune systems will grow once vaccines have stopped and as the puppy gets older ( same as human babies) . During the first month or two at home keep your puppy away from places where dogs congregate like PetSmart.Do not allow puppy to walk on Vet office floor. Keep puppy off yard grass and side walks until shots are finished. Wash your hands when you come home from shopping. Spray the bottom of the shoes of people visiting your home with lysol.Once a small breed puppy is 7 or 8 months old the immune system is stronger , vaccines finished and these precautions can end.
.Jurisdiction
No disagreement is ever expected, but if any disagreement arises, it will be settled by a court in San Joaquin County, State of California.
Facsimile/Electronic Signature
The parties hereto agree that this Agreement may be executed by facsimile/electronic signatures and such signatures shall be deemed originals.
This contract is valid for the original purchaser of the dog from Munchkinland Chihuahuas(Seller). If the dog is transferred to another owner then this contract is null and void.
Any part of the agreement that becomes void, does not void any other parts of the agreement.
Any puppy or dog that becomes homeless may be returned to us for re-homing or permanent homing at our discretion, without refund, credit or replacement.
Buyer agrees that sending a deposit for purchase of a puppy will automatically bind buyer under these contract terms with the seller even if contract is not signed.
Seller requests Buyer print and mail or scan and electronically mail a signed original contract to Seller and to retain a copy of the contract agreement for them.
